External Referral Program Terms & Conditions

 

Eligibility Requirements for the External Referrer (the “Referrer”):
To participate in the Program and be eligible for the referral payment, the Referrer must satisfy the following requirements:

  • The Referrer must be an individual person (not a business entity) who is at least 18 years of age and a legal resident of the United States.
  • The Referrer cannot be currently employed by C&M Legal Search as part of the internal recruiting team.
  • The Referrer cannot be a former C&M Legal Search employee or retiree within the past twelve (12) months of submitting the Referred Candidate.
  • The Referrer cannot be employed by, or a consultant of, a staffing or recruiting agency to who C&M would be obligated to pay a fee.
  • The Referrer must know the candidate they are referring, and the candidate must expressly acknowledge that the Referrer referred the candidate to C&M Legal Search.

The Referrer is not eligible for the Program or referral payment if C&M Legal Search finds, in its sole discretion, that the Referrer fails to satisfy any of the above requirements or that paying a referral payment would create an actual or apparent conflict of interest.

 

Eligibility Requirements for the Referral Candidate (the “Referral”):
To participate in the Program, and for the Referrer to be eligible to receive a referral payment, the Referral cannot be any of the following:

  • The Referrer (i.e., a self-referral).
  • A current internal employee of C&M Legal Search.
  • Already referred within the past 6 months.
  • Has been in contact with C&M Legal Search within the last six months, or placed within the last six months. 

The Referrer is not eligible for the Program or referral payment if C&M Legal Search finds, in its sole discretion, Referral Candidate is any of the above, or that paying a referral payment would create an actual or apparent conflict of interest.

 

Submission Process: 

  • All referrals must be submitted through the External Referral Google Form.
  • The Referrer may only submit one Referral Candidate per submission. 
  • All required information on the form must be completed. 
  • Once the form has been completed, the Referrer must make an email introduction between the referred candidate and our team, either directly with the recruiter you are working with, or via referrals@cmlegalsearch.com. The referral will be considered once they have responded and confirmed their interest.

Referral Candidates must be submitted in strict conformance with the processes outlined in this Agreement. Failure to do so will result in the ineligibility of the Referrer and Referral Candidate.

 

Payment Process:

  • C&M Legal Search will pay the Referrer a one-time referral payment based on the position level the Referral Candidate is hired for by C&M Legal Search’s client company so long as the following requirements are fully and completely satisfied: 
    • The Referrer strictly complied with the processes and requirements outlined in this Agreement and as otherwise required by C&M Legal Search
    • The Referrer and Referral Candidate is eligible for the Program.
    • The Referral Candidate is hired full-time in a Program-Qualifying Position within 6 months of the Referrer’s submission of the Referral Candidate to the Program. 
    • The Referral Candidate completes 90 calendar days of continuous, full-time employment with C&M Legal Search’s client company in the Program-Qualifying Position for which the Referral Candidate was hired as part of the Program.
    • C&M Legal Search receives the Referrer’s completed IRS Form W-9 and any other documentation C&M Legal Search or its payment vendor require in a timely manner.
  • C&M Legal Search shall pay the Referrer within 30 days after the Referral Candidate completes 90 days of continuous, full-time employment in the Program-Qualifying Position for which the Referral Candidate was hired. 
  • Bonus amounts are listed below by Position Level:

Additional Terms and Conditions:

  • Program Qualifying Positions are positions that C&M Legal Search has a qualified job order for from our client company, and are actively seeking candidates for. 
  • The Referrer shall not make any representations or warranties on C&M Legal Search’s behalf concerning the Program or subject matters addressed in this Agreement.
  • Participating in this Program does not create a contractual relationship between C&M Legal Search (or its clients) and the Referrer for any purposes not expressly set forth in this Agreement.
  • In the event that one or more person refers the same candidate for a Program-Qualifying Position, the applicable referral payment will be made to the first referrer who referred the Referral Candidate, based on timing of the completed submission form. 
  • All Referral Candidates will undergo C&M Legal Search’’s standard candidate processes. C&M Legal Search is under no obligation to interview or process the Referral Candidate. 
  • Referrals will expire 6 months from the submission date. After this period, if the referred candidate is not placed, the referral expires and the candidate can be resubmitted.
  • All referral payments C&M Legal Search makes as part of the Program are paid pre-tax. The Referrer is solely responsible for paying all applicable local, state, and federal taxes on any payment received from C&M Legal Search as part of the Program.
  • The Program is effective 8/15/24 through an indefinite period. Changes and refinements to the Program will be initiated and made as needed at the sole discretion of C&M Legal Search. 
  • This Agreement shall be governed, interpreted, and construed in accordance with the laws of the State of Wyoming.
